Films of Lee Oswald--the Martin Shackelford Film List

Marina Oswald was interviewed by Jack Anderson years ago...this video reveals that Lee expressed admiration for Kennedy even in the USSR.

Though Marina -- and I -- can be seen on film, speaking for him, Lee is dead. we only have what has been preserved --and often edited. I have noticed that still photos were often retouched, including a 'smirk' after his arrest in Dallas that I cannot find in any live films. Live films are harder to retouch, though we have evidence that this occurred in the Zapruder film.

Below is one of the films available on YouTube, plus a useful list created by researcher Martin Shackelford that can serve as a base to search on YouTube for some more. Most are still not available on YouTube. As part of Lee's biographical information, these films serve as a good base when trying to separate Lee from imposters.

While Lee told me he knew of impersonators, he welcomed them as serving to protect his true activities. But that backfired in November, 1963. Today some people believe that an individual named "Harvey" and an individual named "Lee" existed as two distinct entities. For many reasons, I believe this theory overextends the truth. Many false tips and faked records have obscured the true Lee Oswald from being understood.it is my hope that everyone reading this blog will read ME & LEE to truly understand the real Lee H. Oswald.

Pre-Assassination. Speculative Films

There may exist presently unknown footage of several types which show Lee Harvey Oswald. One possible type is home movie footage, taken either by members of the
Oswald family, or by relatives, or by people who knew Lee Oswald
(schoolmates and their families, Civil Air Patrol cadets, etc.). A second possible type is home movie footage taken when Oswald was abroad, by tourists on the 2 ships, in Europe or in the Soviet Union or Mexico, or by people who knew him in the Soviet Union (there may be families in possession of such footage who have no idea Oswald is even in it; the Monica Kramer photos of Oswald in the Soviet Union turned up only after an intensive search of tourist photos taken during the relevant time period). A third possible type is footage shot covertly by or for the KGB, the CIA or other intelligence organizations.1.

1. The Home Movie (11-22-62)
In one of the many ironic twists in this case, the
first known motion picture footage of Lee Harvey Oswald was taken one year to the day before the Kennedy Assassination. It was a home movie taken by his brother Robert Oswald's wife Vada when the family gathered that year to celebrate Thanksgiving. Two color frames published in the October 17, 1967 LOOK Magazine excerpt from Robert's book show a smiling Lee Oswald seated on a couch near his half-brother John Pic and Pic's wife, with Marina standing near Lee, and Robert playing with his sons on the floor in the foreground. The two frames are also available from The Collector's Archives (Box 2, Beaconsfield, Quebec H9W 5T6). On November 26, 1990, the film was shown on "Hard Copy," a tabloid television show featuring an interview with Robert Oswald, under the title "Oswald's Home
Movie." This may also be available on video from The Collector's
Archives.

==update: YOUTUBE: Robert Oswald's film is shown almost in is entirety here. Robert has always stated that his brother killed Kennedy. He was compromised, however, in many ways,especially how he is linked to the camera that is linked to the infamous backyard photos. My conclusion is that Robert Oswald said what he HAD to say about his brother, due to his involvement with marina and the fact that his brother's supposed deed could ruin his life. I, myself, have suffered for speaking the truth. Robert's TRUE feelings may be hinted at when he says he kissed his brother goodbye as he lay in the coffin. The look on his face displays, I believe, his heart.

2. The New Orleans films
Oswald's activities in New Orleans attracted the attention of both tourists and a professional cameraman.

2a. The Jack Martin Film (8-9-63)
In another of those aforementioned ironic twists, a tourist named Jack Martin was in Dallas in August 1963. His film records his view from the airplane. Next, he visits General Edwin Walker, under whom he had served, allegedly target of an assassination attempt by Lee Oswald in April of that year. The film documents the scene of that attempt: the window through which the shot was fired, the bullet hole, and the wall from behind which it was most likely fired, ending with shots of Walker's flag and mailbox, and a nearby building under construction (allegedly also photographed by Oswald prior to the attempt!) . Then we see the entrance to a movie theater, cypress trees, a seal at the edge of a pool, and the statue of Andrew Jackson in Lafayette Park in New Orleans.
Aroused by a commotion on Canal Street, Martin crossed to see what was happening, and began filming. We see Lee Oswald, leaflets in hand, standing on the sidewalk, being harangued by anti-Castro militants including Carlos Bringuier. Four police officers are seen arriving. The film ends with a view of the yellow leaflets scattered on the sidewalk after Bringuier knocked them out of Oswald's hands, and a brief aerial view of a subdivision. Parts of the film have only been used, to my knowledge, on the French television documentary, "Le Mystere Kennedy."

The documentary is available on video, and frames from the film as well,from The Collector's Archives. A still from this film was finally published in Robert Groden's 1995 book, The Search for Lee Harvey Oswald, an essential photo archive on Oswald.

2b. The James Doyle Film (8-9-63)
James Doyle was a 16 year old teenager, visiting
New Orleans with his family in early August 1963. His film begins in Lafayette Park, New Orleans, and includes a view of the Andrew Jackson statue. He, too, then noticed a commotion along Canal Street, crossed over to investigate, and began filming. Lee Oswald, back to the camera,is talking with Carlos Bringuier, when a police officer arrives, pushes Bringuier aside, and talks with Oswald, who gestures. Oswald is then seen through the crowd, under arrest, obscured, moving to the left, and we see him and the officer at curbside. The film ends with harbor views. To my knowledge, this film has only appeared in one television program, the British "Dispatches: The Day the Dream Died," available (as are frames)
from The Collector's Archives or from All That Video (405 Hopkins Court,North Wales PA 19434, phone (213) 361-1365.) A still from this film was also first published in the 1995 Groden book.

2c. The Johann Rush Films (8-12 & 16-63)
Johann Rush was a news cameraman for WDSU-TV in New Orleans in the August of 1963. He was on hand on August 12 when Lee Oswald appeared at the New Orleans courthouse for sentencing after his August 9 arrest. Rush filmed Oswald's approach, then Oswald posed for the camera in a courthouse corridor. The footage also includes Carlos Bringuier and the Cubans. Rush next filmed Oswald's
leafleting at the International Trade Mart on August 16. This is the
footage which shows Oswald and two colleagues (one of them Charles Steele Jr.) distributing leaflets, a figure in the background alleged to be Clay Shaw, and two foreground figures alleged to be Charles Rogers and Chauncey Holt. I won't attempt to catalog the sources in which bits of this footage appears, although the videotape "The Two Kennedys" (MPI Home Video, 1-800-323-0442, may still carry this title, or try The Collector's Archives) is a good source, and stills from the footage appear in many places.

2d. The WWL-TV Film (8-16-63)
The most famous still, however, is from a brief bit of footage also taken during the August 16 leafleting, but by a rival cameraman for WWL-TV named Mike O'Connor, and shows Oswald thrusting a leaflet toward a passerby. Captioned "Garner Deposition Exhibit 1," it appears in the Warren Report, and the footage is used in various documentaries.

2e. The Mike Lala Film (8-21-63)
The final bit of New Orleans footage was taken by cameraman Mike Lala during an interview of Oswald at WDSU-TV on August 21. It shows Oswald in left profile as he
speaks. In the semi-fictional film "Executive Action"(1973, National General Pictures, Warner Home Video),, the footage is used as a training film for an Oswald impostor. As with the other New Orleans TV footage, it is widely excerpted. The Collector's Archives offers two frames from the film.

Post-Assassination

3. The Ron Reiland Film (11-22-63)
WFAA-TV cameraman Ron Reiland was filming at the site of the Tippit
shooting when police were called to the Texas Theater, and Reiland went with them. As a result, he got the only footage of Oswald's arrest. One dimly lit scene shows Oswald being held by police inside the Texas Theater (underexposed, this appears only on "The Kennedy Tapes," which contains the complete Reiland footage, and on "Films From the Sixth Floor" videotape, which includes the films from the Dallas Book Depository exhibits). He then photographed Oswald being led out, placed into a police car, and driven away.

4. The Arrival Film (11-22-63)
An NBC cameraman filmed Oswald when he arrived at Dallas Police
headquarters, and was led into the Homicide Division offices, past
witness and co-worker Billy Lovelady.

5. The "Press Conference" Films (11-22-63)
Various footage exists from the late-night showing
of Oswald to the press, and this is some of the best-known footage of Oswald in custody. After the video ends on one film, the audio track continues with Oswald's voice for a short time longer.

6. The Hallway Films (11-22 to 24-63)
Soon, the Dallas Police Department
hallways were swarming with reporters and cameramen. There is footage of Oswald being led from room to room at Police Headquarters taken by ABC, NBC, CBS, local stations, and foreign cameramen. This includes the footage of Oswald's various denials: "I didn't shoot anybody, no sir." "I don't know what you people have been told, but I emphatically deny these charges." his statement that this was all happening "because I lived in the Soviet Union," etc. A great many of these films are included in the series "The Men Who Killed Kennedy" (Time-Life Video). There is also Hearst newsreel footage of Oswald in the hallway.

7. The Shooting Films (11-24-63)
ABC footage shows Oswald being led off the
jail elevator, and through the jail office area. Another piece of footage shows Oswald from behind as he moves out toward newsmen in the jail basement. Then a number of cameras (including the three networks and Hearst newsreel) captured him from the front as he is led out, and Jack Ruby lunges forward and shoots him. He is then out of the scene briefly. Most of this footage is also widely available.

8. The Post-Shooting Films (11-24-63)
When the ambulance arrives, Oswald is brought out on a stretcher, and loaded into it. We see Oswald inside as the ambulance
drives away. We next see footage of the ambulance arriving at Parkland Hospital with Oswald, Oswald being pulled out on the stretcher, and rushed into the hospital. This is the last known footage of Oswald alive, as well as the last publicly available. It is widely available.

9. The Exhumation Autopsy Videotape (10-4-81)
Lee Oswald's body was exhumed
on October 4, 1981 at the request of British author Michael Eddowes, with the cooperation of Marina Oswald and over the objections of Robert Oswald. A partial autopsy was performed at Baylor Pathology Laboratories, and the procedure was videotaped. Following a lengthy dispute about possession of the videotape, it is my understanding that Marina Oswald regained possession of it. There are no plans to make it available to researchers, but it may enter the record at some point in the future.

I started reading your book as soon as it arrived. Weeks after finishing it, I am still without words.

In some way, I seem to inhabit so many of the scenes of this tragedy.

If you prayed for the book to produce an effect beyond the usual domain of crafted words, then as far as I am concerned your prayer was answered abundantly, powerfully.

I hope that you were, or will be, able to see ex-Gov. Ventura's Conspiracy Theory TV program (on TruTV). The most recent one (11/19 here) was devoted to JFK (and actually aired, while the usual 11/22 propagandists remained strangely silent, no doubt concocting their worst efforts for the 50th anniversary).
The Governor certainly performed a much-needed service for our country, for every person who is contending with the cognitive and spiritual warpage which overspreads our age. Somehow, Ventura elicited an admission of "lone gunman doubt" from none other than Gary Mack, and then reduced Vincent Bugliosi to incoherency, by refusing to be browbeaten by that eminent jurist's usual tactics of intimidation (verbal goosestepping, the anti-rational marshalling of long-disproven 'facts' reanimated by the brute force of ego).
Even further, the Governor (in a memorable jeremiad of a summation) declared outright that LHO was indeed a patsy, and innocent, having played no criminal part in the hideous events of that day.

This year, I found myself observing 10/18 (more each year, for the past several years). Any more, there is no 11/22 without 10/18.

You must have poured your entire life, your entire self (and Lee's) into this book. How it intensifies the "will not leave one alone" quality of those times, places, and events.
To call Me & Lee a tidal wave is sickeningly inadequate.
May this towering wall of truth sweep away the generations of lies from our history, and recreate a living landscape fit for America and Americans (worthy of the name) once more.
Above all, thank you on behalf of our stricken nation for undergoing the Unspeakable that it must have taken to bring into being this unparalleled record of youthful love, scientific zeal, idealism, and patriotism--all inextinguishable, and which will, surely, shine brightly forever.

THE KENNEDY ASSASSINATION, LEE HARVEY OSWALD, AND MY RECORD OF HIS WORDS

ME & LEE: HOW I CAME TO KNOW, LOVE AND LOSE LEE HARVEY OSWALD --AND WHY I DID NOT FORGET HIS WORDS

I am being asked how I’ve been able to remember conversations that occurred decades earlier. At one time, I was able to read a page and recite every word on the page, but since having sustained several concussions a decade ago, I’ve lost that ability. However, I still retain an excellent memory for details, as anyone knows who converses with me. Recently, however, I have been asked how I could possibly have remembered, in full detail, the conversations as presented in the book Me & Lee: How I Came to Know, Love and Lose Lee Harvey Oswald. (see http://www.judythvarybaker.com for more information).
Indeed, when I first presented our conversations in book form, in late 1999, I was afraid to place them in quotes for fear I wouldn’t be believed. “How could she remember so many details?” could have seemed a quite reasonable question, unless one had met me and knew how entirely precise I could be concerning details on almost any subject. I have been blessed (or cursed) with the ability to remember almost everything I’ve ever read. My brain is actually overloaded with information.
Nevertheless, most of the conversations in the book Deadly Alliance, -- the first largely accurate book about “Me and Lee” -- written with the help of researcher Howard Platzman -- were recorded in “he said,” and ”she said” mode.
That book did not convey enough information, based as it was on emails passed back and forth, though it was a vast improvement over the ‘teaser book’ shown to publishers a year earlier, which contained very little information. The teaser book was a means to see what publishers might be interested in what I had to say without revealing key matters that I held back until I could determine which publisher(s) could be trusted.
Unfortunately, at the time I had a literary agent who tried to force the CBS news magazine Sixty Minutes to take “his” producer --- Isidore Rosmarin--- who had produced some stories for Sixty Minutes in the past --to film my story.

But Sixty Minutes wanted to use a different producer. When the agent refused to cooperate on this and other matters, I fired him.
There would be no more meetings with publishers, after that bad experience with an agent, for a decade. Even my association with the seasoned researcher, Harrison E. Livingstone, who went on to publish an unauthorized version of my book, was wholly through emails. But Livingstone wanted the book to be published quickly. Consequently, he did not allow me to check it for errors. It had far too many, and I stopped its publication.

Disappointed with Livingstone’s incomplete editing job, I returned to my original plan – not to have the information published until after my death. I would just go on with my life—if possible. But I was being harassed and threatened. And Internet newsgroups had set out to destroy my reputation. I defended myself, which simply gave them material to alter, or to shamelessly quote in bits and pieces out of context. When I corrected false statements that they attributed to me, they said I had changed my story. They even published so-called contradictions that they, themselves had created. In addition, false stories were circulated, such as that I had changed my name to “Vary” from “Avary” because I was ashamed of my family’s name – a story even mentioned by the respected researcher, Jack White, who believed it was true.

The truth: my maiden name was "Judyth Anne Vary." I never 'hated' my family name, and my family name was never "Avary." I used "Avary" as a FIRST name when teaching at the University of Louisiana for six years, so that the name "Judyth" would not be used -- I was afraid of being linked to 1963 too easily. Many equally silly stories have been passed around, along with unfounded accusations and speculations.
Apparently “anything goes” in newsgroups, but I mention the problem here because other "quotations" are rampant in the newsgroups that are equally absurd and unfounded.

Most newsgroups have been infiltrated by persons who deliberately create dissent, parroting old government-sponsored lies about Oswald that have long been disproven, but which the government continues to disseminate.
I call such defenders of that obsolete stance traitors to their country. They believe that for the security of the country, these intelligent and clever liars have decided that we should not know who killed Kennedy (the government, through the Mafia, supported by the far right and a military-industrial complex coalition that developed eternal warfare with our neighbors, greedily promoting the financial and moral rape of America’s middle class). I am proud of the scars I carry due to these traitors.
I had decided to go to the grave, originally, with what I knew, and to simply let my son publish the book posthumously. Then I would not have to battle the forces that could (and did) ruin my life. However, two factors came into play to change my mind about going to the grave before this vital information about Oswald was released to the public: 1) my son was unaware of the milieu in New Orleans, and in the nation, in 1963, and, worse, knew almost nothing about the lies and falsehoods circulating about Oswald. He would be unable to defend the book. 2) I realized that he would not understand the value of the materials I had saved from the past, and how they helped me achieve the feat of remembering the conversations.
A streetcar ticket dated April 28, for example, would have little meaning for my son, whereas for me, it evoked a host of sharp, strong memories, including key conversations. The streetcar ticket shown on p. 145 in the first printing, first edition of Me & Lee, represented the second time I had ridden the St. Charles streetcar in New Orleans. I had failed to save the first ticket, but I saved the second one.
Ihis streetcar ticket and the announcement of the opening of Pontchartrain Beach were saved together…just one example of how I made sure I kept a good chronology of events. Even the time of the streetcar ride is indicated on the ticket.

Each time I looked at that ticket, over the years, a surge of memories of that pivotal day broke over my thoughts in a cascading stream of events. I could remember almost every moment, the most important of which was Lee’s confession that he had beaten his wife. That confession impelled me to decide to go ahead and marry Robert A, Baker, III.
I kept hundreds of such items, and with the help of a diary ---until it was stolen and burned in my very front yard – an event for which I have witnesses --- I was able to keep my memories quite fresh.
Once a year, around Thanksgiving, I would go through several boxes of ‘old things’ – a habit that also produced stacks of Christmas ornaments and other items to begin Christmas decorating. I would dedicate a whole day to what I believed was my duty: not to forget. After my 1986 divorce, I was able to spend far more time going over the conversations and events, without fear of being discovered. My goal was to one day tell Oswald’s beloved daughters just exactly who their father was, but I was also anxious that they would understand exactly why and how their father had come to have a love affair with another woman while still married to their mother.
Their father was entirely innocent of the grave charges against him—the killing of the President, and of a Dallas police officer—and I was determined that Lee Oswald’s sacrifices for his country would not be forgotten. I realized that not only Oswald’s daughters, but also the whole world, would have no way to hear their father’s voice if I did not preserve his words in my memory.
After the assassination of President Kennedy, Lee’s wife, Marina, had been under tremendous pressures. She could have been deported, and her American-born baby left behind, for example, so of course I forgive her for her quailing in the face of threats, as I hope she will forgive me for my existence as “the other woman.” I understand her fears: I was told to keep my mouth shut if I wanted to stay alive, and I did so for decades. Marina was unable to hide. She was in the spotlight.
Life Magazine's Allan Grant photographed Marina Oswald afer the assassination, and the words used to describe that assignment ring with cruel prejudice, with Lee Oswald automatically described by the well-controlled media as Kennedy's killer --which is still the case today:

It was no secret that Oswald’s marriage was miserable. It improved when the couple lived in New Orleans, for Lee had promised me that he would never strike his wife again, and he kept his promise, knowing that I would have nothing more to do with him if he broke it. As Lee Oswald learned to control his anger – his wife could say very cruel things, and could be very provocative – I saw him mature before my eyes into the man he yearned to be –more gentle, sensitive, and kind. Lee Oswald was always kind to animals and children, but I reminded him that Hitler had dogs he loved, and was quite kind to children. They were no threat to his manhood. It was Lee’s challenge, I insisted, to become the kind of man I knew he really could become.
Witnesses who defended Lee Harvey Oswald were ignored – and some died under suspicious circumstances, or were actually murdered. Then, for decades, the public was given a grossly distorted picture of the accused assassin, based on a mass of poorly handled and sometimes faked evidence. But it was Lee Harvey Oswald who intervened to save Kennedy’s life – at the risk of his own—in Chicago. It was Lee Harvey Oswald who joined an ’abort team’ that was organized to try to save Kennedy in Dallas.
Thus Oswald had to be eliminated, even before the eyes of millions, before he could tell reporters and others who was responsible for the President’s death.

Lee Harvey Oswald was shot to death by someone who had been a friend of his for years – the Dallas Mafia bagman and police fixer Jack Ruby, who ran a local nightclub. Ruby later told reporters that “a new kind of government” was taking over the country. The reason he had to kill Oswald would never become known, he said, because those in “high places” would make sure of that.

I had been forced into silence to save my life. But I finally realized that if I did not speak out during my lifetime, I would have no way of defending the book, Oswald’s words, or the researchers and witnesses who already given so much to get the truth to the people. By speaking out, my career – to be a respected professor of English -- was destroyed. I was also heckled, harassed, threatened, and harmed, to the extent that I had to leave the country twice, and finally, in 2007, permanently, becoming the first American non-combatant woman to seek political asylum in the EU system.
There I was sheltered for over ten and a half months –as long as the system could legally keep me (for the US is not on the list of countries from which asylum seekers could be accepted), until my family and friends found ways for me to live in safe places overseas, far from my enemies. To this day I rely on donations to pay for the medical problems I still have from the so-called “accidents” I suffered while living in Dallas, where I had moved in order to try to find more witnesses to help me defend Oswald.
I wish to make it clear that the conversations that Lee Oswald and I shared were memorized and kept fresh in my memories over time because they were not the ordinary kind of conversations that a man and a woman share, who are in love. They were conversation kept intact in my memory because they were conversations involving the planned murder of Cuba’s communist leader, Fidel Castro, the clandestine development of formidable bioweapons, and the knowledge that Lee Oswald confided to me that he had penetrated an assassination ring intent on killing Kennedy. Would YOU forget such conversations?
Lee told me, too, that he was “better off dead to both sides” –the Communists and the CIA – because neither side could trust him. This was the man accused of killing President John F. Kennedy. It was my solemn responsibility, therefore, to retain the memory of what Oswald said. I do not pretend to have recalled every word he spoke, but I can guarantee that everything written in these conversations represent the true mind of Oswald as he confided his thoughts and concerns to me. Over the years, if I recalled something that I had missed, I would enter it under the proper day, and even the hour.
Mary Ferrell, upon seeing my personal chronology, gave me a personal copy of her own. Her gift allowed me to find the information I badly needed concerning Fernando Fernandez, a pro-Castro spy about whom I could previously find nothing . Finding his name in the Ferrell chronology was a relief, for it allowed me to see that I had correctly recalled everything about him.
I was surprised, however, to find a number of errors in Ferrell’s chronology, which I have pointed out to researchers. Most of these “errors” are traceable to misinformation deliberately generated to falsely implicate Oswald. The prejudice in Ferrell’s chronology is obvious in such statements as “Oswald shot at General Walker,” and her entirely unreasonable living allowance for him and his family, which fails, for example, to take into account transportation and medical expenses. I have my own record of expenses for my life in New Orleans at that time, to the very penny, and I could not have lived on the puny allowance Ferrell applies to Oswald, his pregnant wife, and their toddler. Her point seems to be that he was able to finance everything without help from outside sources: this is not true.
When the book Me & Lee was being edited in an attempt to make the story shorter and more accessible to the general public, sometimes a few words would be changed or left out, and I would inform one of the editors involved that such-and-such words had to be retained. Presently, I see only one word in Oswald’s conversation printed in error in the first printing of Me & Lee -- on p. 457 the word “gravitating” is used, when Oswald actually said “grav-tating” --- a “typo” that was “corrected” by the editors without my noticing it.
There are a few other problems that will eventually be corrected that are now present in the 606-page book —a sentence is repeated, a photo of witness Mac McCullough is missing, and a photo of Charles Thomas, AKA Arthur Young, is mislabeled, with its hand-written message truncated. There are also a few typos in the mass of end notes, too, but all-in-all, the editors improved the book immensely. In particular, Edward T. Haslam, the author of Dr. Mary’s Monkey, made important and insightful improvements to the book. His expert knowledge of New Orleans meant that he was also able to obtain information about Mary Richardson, a then-young, socially-active wife of a well-known minister who could have been an important witness in the case. But chillingly, she died of an unexpected and suspicious heart attack only sixteen days after the assassination.
I want everyone to know that every sentence in the book coming from Oswald’s mouth is as close to what he said as memory has permitted. To anyone who wonders how I could have preserved the conversations, please remember: Lee Harvey Oswald was no ordinary man. This man was accused of killing Kennedy. These were historic conversations. If you had been in the position I was – in love with this innocent man – a man accused of killing Kennedy-- I believe that you, too, would have made an extra effort never to forget.

“THE ‘25’ LIST” (Choose the version you prefer from two listed here)

1) Unbiased legal representation must be provided: no arraignments without legal representation. Prisoner must know who his/her accusers are. The assigned lawyer must not have a conflict of interest in the case, must be free to investigate, must have funds to investigate, and has the right to access evidence and accusations against the client. The lawyer can be replaced at the client’s request.

(Lee was arraigned twice without a lawyer, and charged with two murders...he said on live TV that he asked someone to come forth to represent him....reporters were told tat despite Lee's several pleas for a lawyer, and telephone calls to reach a lawyer, in his private arraignments he said he didn't want a lawyer! -- even though Lee was still asking for a lawyer after that 'no lawyer wanted' statement was made to the press).

(2) Charges must be filed within 72 hours, or release must be made on reasonable bail
(no more Gitmo 'non-combatant detainee' situations). Prisoner must be made aware of all/new charges.

(3) The word 'detainee' will be prohibited if a person is arrested and then held more than 24 hours: the word 'arrest' will be used when a person is arrested and held more than 24 hours.

(4) Torture, in all forms, to be prohibited, as per Geneva Convention treaties.

(5) All interrogations shall be filmed, with adequate sound levels, and will be available, unedited and uncut, to the prisoner's selected lawyer and advisors. The press, friends, public and family have the right to view and hear (but not copy) such films; the prisoner, (or, if deceased, prisoner's family/lawyer) upon release will be given an uncensored copy of all interrogations (interrogators' faces can be shielded from view).

(6) No playing up to the public that the suspect is guilty before a fair trial.

(7) The right to immediate medical attention, to adequate and reasonable access to edible and nutritious food, potable water, etc. (During his Dallas arrest, Lee Oswald was beaten, but was given no medical care or attention...I have found only one record of his being given a meal in two days...when held in jail in New Orleans, Lee was given a tray of food with jail floor dirt and dead roaches sprinkled on top. Said Lee, smiling: “Ah! Roach a la mode!”)

(8) The right to be interrogated unbound, and unstressed (Lee was handcuffed with hands behind his back for hours, while interrogated, in his beaten condition).

(9) After being frisked and subjected to a body search, and any DNA/other tests deemed necessary, no 'evidence' 'found' later on the person of the prisoner, or on, or in, what he was wearing when arrested, will be admissible as ‘evidence’ or at a trial

(It came out in 2008, according to the officer involved, that Lee was frisked and searched when arrested at The Texas Theatre...Lee was frisked and searched again when he was booked...somehow, hours after his arrest and booking, five .38 caliber bullets were suddenly 'found' in one of Lee's pants pockets, conveniently matching the non-automatic revolver (that somehow no longer worked) 'found' on Lee in the Texas Theatre -- said to have been used to kill Dallas police officer Tippet -- though shells found at Tippet’s murder scene came from a semi-automatic weapon, not from the "Texas Theatre' weapon, which was a simple snub-nosed .38 S&W...'the' weapon of choice for off-duty Dallas policemen, at the time, to carry around. The bore of this snub-nosed revolver made it impossible to directly match bullets fired from it, but the caliber of the bullets was another matter... hence, apparently, the necessity to plant additional 'evidence' -- the .38 caliber bullets --in Lee's pants pocket...)

(9) Fair lineups conducted, with at least five similarly dressed persons of similar age and physical characteristics.
(Lee was lined up various ways that were unfair: for example, he was wearing a torn shirt, had a black eye and tousled hair, was quite thin, and was only 24...but was lined up with just three older, heavier Dallas Police employees who were wearing clean, pressed office clothing, and ties. Later, Lee was lined up with teenagers from the nearby jail, who wore jail uniforms, and obviously hadn't been in the outside world, while Lee, older than they, was presented in his white, rumpled tee-shirt, and other street ‘garb.’

Though there was room for more men to stand in the Dallas lineups -- two extra spaces could be seen in extant photos ---- only 3 people at a time stood with Lee in the various lineups, making it easier to pick him out even by chance --25%.)


(10) In all lineups, the person's name, occupation, and/or place of work is not to be mentioned to viewing witnesses.

(Lee was forced to stand forth, and give his name -- his name was in all the newspapers already -- and his workplace -- was also mentioned in the newspapers....while, in contrast, the three Dallas police department employees standing with him gave their (non-notorious) names, and their (prestigious) workplaces -- the Dallas police department -- only an idiot would think any of those three men working for the Dallas police department might have been 'the' guilty man!)

(11) Witnesses watching lineups will not be influenced by verbal or body language, or in any other way, to pick out the 'right' person in a lineup: filmed records with adequate sound will be provided to the prisoner’s lawyer and the press upon demand (witness’ faces can be obscured).

(on record for one of Lee’s lineups: a policeman asking a female witness to re-think her wrong choice and to look again at a man standing under a different number, the number named outright....she finally got the hints, and chose Oswald)

(12) Prisoners on trial or being arraigned will not be presented before the judge or placed on trial 'with a jury of peers' wearing prison garb, unusual clothing, or soiled, torn clothing, but will be dressed as would be members of a jury of peers.

(Example: until the 1980's, prison garb was not worn by those 'presumed innocent until found guilty.' Old Perry Mason TV programs show the accused person wearing ordinary street clothes, suits, etc. This is no longer the case. Prisoners attend their trials today in the US and many other countries in prison garb. Such garb constitutes a statement of prejudice against the accused. A person in an orange jump suit already looks guilty. How is he/she a 'peer'? This must change.)

(13) No prisoner is to be kept while on trial or while being interviewed by the press in a cage, or in any other humiliating or demeaning manner, such as blindfolded (though he may need to be handcuffed if deemed dangerous to others) : such practices/confinement implies guilt or danger.

(14) Photos selected for the press, or created/used by the press/anyone else must present the prisoner, whenever possible, in a neutral light. Nor should photos be retouched to create a different facial expression, skin complexion, or to distort.

(Lee’s photos were selected, in some cases, and a few altered, to make him look like he was smirking, while other photos were retouched to reduce the appearance of his having been beaten. His bruised nose, for example, was retouched in some photos, and many photos were selected showing Lee at unattractive angles...Some photos were flipped, enhancing Lee’s swollen black eye as if it was his right eye (facing the viewer) --- which was probably hit by a left-handed policeman. However, Lee was actually struck by a right-handed policeman in the left eye. The policeman in question said he, the policeman, was holding a revolver when he approached Lee in the Texas Theater. Next, he says he reached down and grabbed Lee’s revolver. How could he have put away his own revolver? To grab it, he had to have a free hand. A flipped photo could solve that problem, or perhaps it as a coincidence. During the ‘midnight press conference,’ when Lee was televised live, and photos could not be retouched, Lee Oswald looked surprisingly attractive, wasn't 'smirking' and presented an attitude that wasn't 'cocky' -- unlike the impression given by photos ).

(15) A prisoner is to have access to friends, lawyers, legal help, family and press without being subjected to drugs, threats, or stressful/humiliating conditions. A prisoner who is married and/or has children of any age can have direct physical access to these persons, if the marriage partner and/or children request it.

(16) A reputable doctor, whose name must be available, will certify that the prisoner has not been drugged, or threatened, before all public meetings, or after them, and that all the prisoner's medical problems have been adequately addressed (example, if a prisoner needs dialysis, he will not be denied dialysis, nor will it be delayed, nor will the prisoner's interviews be delayed on any such excuses). The prisoner’s uncensored medical records will be available to other reputable physicians at the request of the prisoner or his lawyer for examination.

(17) The prisoner will be held/jailed in the same country, and, when possible, in the same geographical area, as friends, family, and counsel are located, unless a state of war or martial law exists.

(18) Trial dates cannot be changed within 5 days before trial date (persons/witnesses buying travel tickets have been financially stressed by frequent trial date changes, helping to guarantee that certain people cannot reach trial site) unless the prisoner/judge, other highly important person has become certifiably ill, has died, or is now incompetent.

(19) Prison guards/personnel must eat the same food, and drink the same water, as their prisoners, with the same frequency/accessibility, and with the same serving sizes/number of refills as all prisoners.

(20) Prison guards must be clothed at the same level of comfort as all prisoners (if coats are needed, due to cold, all prisoners must have suitable coats). If prison officials need to use fans or air conditioning in their offices, prisoners must have fan circulation, and/or air conditioning, too. Light levels, and how long lights are on or off, must be the same for all prisoners, prison guards, and daytime-open prison offices.

(21) Religious rights, access to religious rites and religious clerics, and access to uncensored religious holy books will be provided all prisoners. Holy books/items reverenced by the prisoner will be respected.

(22) Prisoners will have the right to make out legal wills created in the presence of a lawyer of their choice. The process of writing and accepting the will must be recorded on film, with audio and such recordings must be given to friends/family/others mentioned in the wills, with true text copies of the will.

(23) Prisoners will have the right to natural sunlight, adequate and clean shelter, adequate bedding and bedding materials, toilet -and- wash access in cells, and regular exercise opportunities.

(24) Prisoners will not be kept in solitary confinement without access to regular non-threatening human contact, including the right to meet weekly with friends, family, the press, and requested lawyers for up to 70 minutes (10m rule). Prisoners kept in solitary must have full TV, phone call, and library privileges.

(25) No prisoner will be subjected to 'cruel or unusual punishment.'

J. Edgar Hoover, head of the FBI, told President Johnson that Lee Oswald was the sole gunman the first day of his arrest. The FBI issued a statement that Lee Oswald was the guilty man the first day of his arrest.)

(15) A prisoner will have access to friends, lawyers, legal help, family and press without being subjected to drugs, threats, stressful/humiliating conditions etc. A prisoner who is married and/or has children of any age should have direct physical access to these persons, if the marriage partner and/or children request it. The increasingly stringent requirement to not allow touch between the accused and loved ones is cruel and unjustifiable.

(16) A reputable doctor, whose name and credentials must be available for nspection, will certify that the prisoner has not been drugged, or threatened, before and after all public meetings, or interrogations, and that all the prisoner's medical problems have been adequately addressed (example, if a prisoner needs dialysis, he will not be denied dialysis, nor will it be delayed). The prisoner’s uncensored medical records will be available to other reputable physicians, at the request of the prisoner or his lawyer, for examination. The prisoner has the right to a second medical opinion via a private physician of choice.

(17) The prisoner will be held/jailed in the same country, and, when possible, in the same geographical area, as friends, family, and counsel are located, unless a state of war or martial law exists.

(18) Trial dates cannot be changed within 5 days before trial date unless proven unmitigable circumstances or health problems occur for: prisoner and/or judge and/or prisoner's legal counsel (persons/witnesses buying travel tickets have been financially stressed by frequent trial date changes, helping to guarantee that certain people cannot reach the trial site) .

(19) Private companies will not run prisons, since certain prisoner comforts, needs, and rights can be ignored in favor of higher profits. Wherever prisoners are held more than 30 days, prison guards/personnel must eat the same food, and drink the same water, as their prisoners, with the same frequency/accessibility, and with the same serving sizes/number of refills as all prisoners.

(20) Private companies will not run prisons, since certain prisoner comforts, needs, and rights can be ignored in favor of higher profits. Wherever prisoners are held more than 30 days, Prison guards must be clothed at the same level of comfort as all prisoners (if coats are needed, due to cold, all prisoners must have suitable coats). If prison officials need to use fans or air conditioning in their offices, prisoners must have the same fan circulation, and/or air conditioning, too. Light levels, and how long lights are on or off, must be the same for all prisoners, prison guards, and daytime-open prison offices.

(21) Religious rights, access to religious rites and religious clerics, and access to uncensored religious holy books in good condition will be provided all prisoners upon request. Holy books/items reverenced by the prisoner will be respected.

(22) Prisoners will have the right to make out legal wills created in the presence of a lawyer of their choice. The process of writing and accepting the will must be recorded on film, with audio, and copies of such recordings and records must be given to friends/family/others mentioned in the wills, including true text copies of the will.

(23) Prisoners will have the right to natural sunlight, adequate and clean shelter, adequate bedding and bedding materials, toilet -and- wash access in cells, social contact with other prisoners, insofar as is safely possible, and regular exercise opportunities.

(24) Prisoners will not be kept in solitary confinement without access to regular non-threatening human contact, including the right to call and/or meet weekly with any of the following: friends, family, the press, requested lawyers, physicians, for up to 70 minutes (10m/day rule). Prisoners kept in solitary must have TV and library privileges.

(25) No prisoner will be subjected to 'cruel or unusual punishment.'
